Terms and Conditions of Sale

These Terms and Conditions of Sale (T&C of Sale) govern all sales made on The Park, whether they concern products from the official shop or purchases made between members on the marketplace and at auctions. Any order implies full and complete acceptance of these T&C of Sale.
1.Purpose and scope
These T&C of Sale set out the rights and obligations of the parties in connection with the sale of products and collectible cards on The Park platform (the “Service”).
Two types of sales are distinguished: (i) sales made by the official shop, carried out by the publisher or its partner; (ii) sales made between members (peer-to-peer marketplace and auctions), for which The Park acts solely as a technical intermediary facilitating connection and payment collection.
2.Identity of the professional seller

3.Products and availability
The essential characteristics of the products (boosters, displays, decks, merchandising and cards) are presented on the corresponding listings. Photographs and visuals are provided for illustration purposes and do not bind the publisher beyond the described characteristics.
Offers are valid while stocks last. In the event of unavailability after an order, the buyer is informed and refunded the corresponding amounts.
4.Prices
Official shop prices are shown in euros, all taxes included, excluding delivery charges, which are specified before the order is confirmed.
Prices displayed on the member-to-member marketplace are set freely by sellers. They are indications between enthusiasts and are not guaranteed by The Park: the actual value of a card depends on its condition and on the market.
The Park reserves the right to change its prices at any time; products are invoiced on the basis of the rate in force at the time the order is confirmed.
5.Wallet and credits
Member-to-member purchases can be paid via the internal wallet. Users top up their wallet by bank card through Stripe, with a minimum amount of €5 and a service fee of 5% applied to the top-up.
Topped-up amounts constitute non-refundable and non-withdrawable deposit credits: they can only be used for purchases on the Service.
Earnings received by a seller are credited to a separate balance, which can be withdrawn to their bank account under the conditions of the Sellers' Rules.
6.Order
The buyer selects the products, checks the details of their order, then confirms it. Confirmation constitutes acceptance of the price, of the product descriptions and of these T&C of Sale.
The Park confirms the order with a summary accessible in the “Orders” area. The sales contract is formed upon confirmation of the order.
7.Payment
Bank card payments are processed by the provider Stripe, in a secure environment. The Park never has access to full bank card numbers.
The order is only processed after effective confirmation of payment. In the event of an authorization refusal, the order is automatically cancelled.
8.Delivery
In-stock products from the official shop are shipped within 48 working hours. Delivery times then depend on the carrier and the destination.
Shipments between members are the seller's responsibility; the secure shipping option described in the Security pages is recommended for high-value transactions.
The risks associated with transport are transferred to the buyer at the time of physical delivery of the parcel.
9.Right of withdrawal
For purchases made from the official shop, the consumer buyer has a period of fourteen (14) days from receipt to exercise their right of withdrawal, without having to justify their decision.
The refund is made within fourteen (14) days after receipt of the returned product, in its original condition. Return costs remain the buyer's responsibility, except for non-conforming products.
The right of withdrawal does not apply to sales between individuals, which are final once the transaction has been validated by both parties.
10.Legal warranties
Products sold by the official shop benefit from the legal warranty of conformity and the warranty against hidden defects, under the conditions provided for by the Consumer Code and the Civil Code.
These warranties do not apply to normal wear and tear, nor to damage resulting from misuse or poor storage of the cards.
11.Member-to-member purchases (marketplace and auctions)
In member-to-member sales, The Park is not a party to the sales contract: it provides the connection tool, secures the payment and oversees any dispute.
The buyer undertakes to honor payment for any auction won; a bank pre-authorization may be requested to take part in auctions. The seller undertakes to ship a product that conforms to their listing.

12.Complaints and mediation
Any complaint must be sent via the Support area. In the event of an unresolved dispute, the consumer may resort free of charge to a consumer mediator.

13.Governing law
These T&C of Sale are governed by French law. Failing an amicable resolution, the competent courts shall be those of the jurisdiction of the publisher's registered office, subject to the mandatory rules protecting the consumer.
